TERMS OF USE Last Updated: May 2026 Version: 2.0 PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING SCOUT IT OUT. BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS.
1. ACCEPTANCE OF TERMS By downloading, installing, or using Scout It Out ("the App," "the Service"), you ("User," "you") agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Scout It Out ("Company," "we," "us," "our"). Your use of the App also constitutes acceptance of Apple App Store and/or Google Play Store terms where applicable.
2. ELIGIBILITY AND ACCOUNT REGISTRATION
2.1 Age Requirements This Service is intended for adults aged 18 and older acting as parents or legal guardians. Children under 13 may use the child-facing features only under direct parental/guardian supervision and with parental consent in accordance with COPPA (Children's Online Privacy Protection Act).
2.2 Parental Authority and Consent By creating an account and adding a child profile, you represent and warrant that: - You are the parent, legal guardian, or have appropriate legal authority over the child(ren) listed in your account. - You have the legal right to consent to data collection and processing on behalf of your child(ren). - If you are subject to a custody order or parenting plan, your use of this App complies with all applicable court orders.
2.3 Co-Parent Access Both parents or guardians may register and use the App. Each user is responsible for their own account and for ensuring their use complies with any applicable court orders or parenting agreements.
3. DESCRIPTION OF SERVICE Scout It Out is a family coordination and child emotional wellness support tool designed to: - Help separated or co-parenting families manage shared schedules and transitions - Support children's emotional well-being through guided check-ins, journaling, and age-appropriate coping tools - Facilitate respectful co-parent communication - Provide children with a safe digital space to express feelings The Service is NOT a substitute for professional mental health care, legal advice, crisis intervention services, or medical services. In case of emergency, call 911 or your local emergency services immediately.
4. NOT A MENTAL HEALTH PROVIDER 4.1 Scope Limitations Scout It Out is a wellness support tool and does NOT constitute: - A licensed mental health service or therapy platform - A crisis intervention service - Medical advice or diagnosis - Legal advice 4.2 No Therapeutic Relationship Use of this App does not create a therapist-patient, counselor-client, or any other professional-client relationship. 4.3 Professional Referral If your child is experiencing a mental health crisis, suicidal ideation, self-harm, abuse, or any serious emotional disturbance, please immediately contact: - Emergency Services: 911 - National Suicide & Crisis Lifeline: 988 (call or text) - Crisis Text Line: Text HOME to 741741 - Childhelp National Child Abuse Hotline: 1-800-422-4453 4.4 Safe Messaging Guidelines Our child-facing features follow evidence-based safe messaging guidelines for discussing mental health with young users. Features are designed with input aligned with child psychology best practices. However, we strongly recommend that families also work with licensed mental health professionals.
5. USE IN CUSTODY AND LEGAL PROCEEDINGS
5.1 Design Purpose for Legal Documentation Scout It Out includes features specifically designed to support legal proceedings, including: - Co-parent communications with automatic timestamping and read receipts - Scout™ communication monitoring (tracks tone and flags concerning language) - Downloadable reports for court filing showing co-parenting communication records - Parent-generated schedule and event records with verification trails This data may be used as supporting documentation in custody matters with appropriate legal review.
5.2 Parent Data — Downloadable for Legal Use Parents may download the following data for use in legal proceedings: - Co-parent email communications (with timestamps and read status) - Co-parent text messages (with timestamps and read status) - Scout Flag reports (documenting flagged communications with tone analysis) - Calendar and schedule records (parent-created entries with modification history) - Parenting time documentation (verified schedule blocks and transfers) These records are system-generated with cryptographic verification and cannot be altered after download, making them suitable for legal proceedings. Downloadable reports include metadata certifying their authenticity.
5.3 CHILD DATA PROTECTION IN LEGAL PROCEEDINGS — COURT ORDER REQUIRED Scout It Out implements strict protections for children's private data: - Child emotional check-ins are NOT downloadable by parents for export or litigation use - Child journal entries are NOT downloadable by parents for export or litigation use - Child-generated content remains private to the child and is protected from co-parent export EXCEPTION: Child data may only be disclosed in response to a valid court order, law enforcement request, or direct legal process served on Scout It Out. In such cases: - We will notify the parent account of the legal request (except where prohibited by law) - We will comply with the minimum disclosure required by law - We do not take sides in custody disputes and provide data neutrally - Child emotional and journal data will ONLY be disclosed if explicitly ordered by a court
5.4 Court Order Compliance Users subject to custody orders, parenting plans, or other court orders are solely responsible for ensuring their use of this App complies with all such orders. Scout It Out does not adjudicate custody disputes or legal matters.
5.5 Prohibited Uses in Legal Context You agree NOT to: - Use this App to surveil, harass, or intimidate a co-parent or child - Use this App to circumvent or violate court orders - Attempt to access, export, or use your child's private journal or emotional data for litigation purposes - Attempt to circumvent child data protections through technical means or court manipulation - Share or subpoena a child's emotional check-ins or journal entries except through proper legal channels with judicial oversight
5.6 Subpoenas and Legal Requests We will comply with valid legal process (subpoenas, court orders, etc.) in accordance with our Privacy Policy. If you receive a court order requiring disclosure of App data: - Contact us immediately through the App's support channel with a copy of the court order - We will process the request in accordance with applicable law - Child data protections remain in effect unless explicitly overridden by judicial order - We will provide documentation certifying the authenticity and completeness of disclosed data.
6. CHILD SAFETY AND SAFEGUARDING
6.1 Zero Tolerance for Child Exploitation Any use of this Service to harm, exploit, abuse, groom, or endanger a child is strictly prohibited and will result in immediate account termination and reporting to law enforcement.
6.2 Mandatory Reporting We are committed to complying with applicable mandatory reporting obligations. If we detect content indicating abuse, neglect, or imminent danger to a child, we will take appropriate action including reporting to relevant authorities.
6.3 Safety Monitoring The App includes automated safety screening of certain child-generated content to detect indicators of crisis, abuse, or self-harm. This is a protective feature, not a substitute for parental supervision or professional mental health care.
6.4 Parental Supervision Parents and guardians are responsible for monitoring their children's use of all technology, including this App, in a manner appropriate to the child's age and maturity.
7. USER RESPONSIBILITIES AND PROHIBITED CONDUCT You agree to: - Provide accurate and truthful information - Maintain the confidentiality of your account credentials - Notify us immediately of any unauthorized access to your account - Use the Service only for its intended lawful purpose - Comply with all applicable local, state, federal, and international laws You agree NOT to: - Impersonate any person or entity - Upload or transmit harmful, abusive, harassing, defamatory, or illegal content - Attempt to reverse engineer, hack, or disrupt the Service - Use the Service to collect data on users without their knowledge - Share another user's private data without consent - Use the Service in any way that could harm children
8. INTELLECTUAL PROPERTY AND TRADEMARKS
8.1 Intellectual Property Ownership All content, features, and functionality of the App (including text, graphics, logos, icons, and software) are the exclusive property of Scout It Out and are protected by applicable copyright, trademark, and intellectual property laws.
8.2 Trademark Rights Scout It Out® is a registered trademark of Scout It Out, Inc. All rights reserved. The Scout It Out name, logo, and associated branding elements are protected trademarks and may not be used without our express written permission.
8.3 Prohibited Uses of Trademarks You agree NOT to: - Use the Scout It Out name, logo, or trademark in any way that could create confusion about ownership or endorsement - Register any domain name, social media handle, or business entity using the Scout It Out trademark or confusingly similar variations - Create products or services that use our trademarks without authorization - Remove or obscure any trademark or ownership notices
8.4 Trademark Misuse Any unauthorized use of our trademarks is prohibited. If you believe your trademark is being misused on this platform, or if you observe misuse of Scout It Out trademarks, please report it to us immediately through the App's support channel or contact us directly.
8.5 License Grant We grant you a limited, non-exclusive, non-transferable license to use this App as intended. This license does not grant you any rights to our trademarks, intellectual property, or the ability to create derivative works.
9. IN-APP FEATURES AND VIRTUAL ITEMS
9.1 Compass Coins and Virtual Rewards The App includes virtual currency ("Compass Coins") and reward items. These have no real-world monetary value, cannot be exchanged for cash, and are non-transferable.
9.2 No Purchases Required All features of Scout It Out are available without any in-app purchases, subscriptions, or payments. Compass Coins and virtual rewards are earned through in-app activities and are not available for purchase. We do not offer, and the App does not facilitate, any real-money transactions.
10. DISCLAIMERS AND LIMITATION OF LIABILITY
10.1 "As Is" Service The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
10.2 No Guarantee of Availability We do not guarantee uninterrupted, error-free, or secure access to the Service.
10.3 Limitation of Liability To the maximum extent permitted by applicable law, Scout It Out and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or emotional distress, arising from your use or inability to use the Service.
10.4 Cap on Liability Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months prior to the claim, or $100, whichever is greater.
11. INDEMNIFICATION You agree to indemnify, defend, and hold harmless Scout It Out and its affiliates from any claims, damages, losses, or expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
12. GOVERNING LAW AND DISPUTE RESOLUTION These Terms are governed by the laws of the United States and the state in which the Company is incorporated, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except for matters involving child safety or imminent harm, which may be brought in a court of competent jurisdiction.
13. CHANGES TO TERMS We reserve the right to modify these Terms at any time. Material changes will be communicated via in-app notification and/or email. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
14. TERMINATION We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms, any behavior that poses a risk to user safety, or any other reason at our discretion. Upon termination, your right to use the Service immediately ceases.
15. APPLE AND GOOGLE PLATFORM TERMS
15.1 Apple App Store If you downloaded the App from the Apple App Store, Apple is not a party to these Terms and has no obligation to provide maintenance or support. Apple is not responsible for any claims related to the App. You agree to comply with Apple's App Store Terms of Service.
15.2 Google Play Store If you downloaded the App from the Google Play Store, Google is not a party to these Terms. You agree to comply with Google Play's Terms of Service.
15.3 Platform Disclaimer In the event of any conflict between these Terms and Apple or Google platform terms, the applicable platform terms will govern solely with respect to the conflict.
16. TRADEMARK INFRINGEMENT REPORTING If you believe your intellectual property rights have been violated or if you observe misuse of the Scout It Out trademark, please report it immediately through the App's support channel. We take all reports of trademark infringement seriously and will investigate promptly.
